01 • ScopeServices & Statement of Work
Beyond Search (“Beyond Search”) provides technical advisory and execution services in AI Visibility, Generative Engine Optimization (GEO), citation engineering, and organic recommendation building. Specific deliverables, diagnostic milestones, and engagement lengths are formalized under individual Statements of Work (SOWs).
Any additional auditing or technical execution outside of an active SOW requires written scope adjustment and mutual agreement.
02 • ObligationsClient Responsibilities
To enable precise optimization and citation engineering, you agree to grant timely access to necessary documentation, domain context files, technical schemas, and team stakeholders required to execute audit milestones.
03 • DisclaimerAI Recommendation Disclaimer
AI platforms (including Claude, ChatGPT, Gemini, Google AI, Meta AI, and Perplexity) and large language model architectures evolve continuously. Third-party model providers regularly update model weights, retrieval augmented generation (RAG) pipelines, and ranking methodologies without advance notice.
While Beyond Search rigorously implements industry best practices, structural schema optimization, and citation engineering, specific recommendation frequency, exact citation placement, search rankings, or individual AI-generated responses cannot be contractually guaranteed.
04 • PaymentPayment Terms & Invoicing
All fees for retainer plans, customized GEO blueprints, and advisory retainers are billed according to the payment terms specified in your Statement of Work. Invoices are payable within 14 days of receipt unless otherwise agreed in writing. Late payments may accrue interest at 1.5% per month or the maximum rate allowed by law.
05 • RefundRefund Policy
Due to the customized, engineering-intensive nature of our AI visibility audits and context mapping deliverables, fees paid for completed milestones or ongoing retainers are non-refundable once work on a billing cycle has commenced, except as explicitly set forth in an individual SOW.
06 • ConfidentialityConfidentiality & Non-Disclosure
Both parties agree to protect and keep confidential all proprietary data, source code, strategy blueprints, and business insights disclosed during the engagement. Confidential Information shall not be disclosed to any third party without prior written consent.
07 • IP RightsIntellectual Property & Ownership
All custom content blueprints, structured data schemas, and domain-specific recommendation files created under an active SOW become client property upon full settlement of invoices. Beyond Search retains proprietary rights to underlying diagnostic tools, benchmark scripts, and internal analytics models.
08 • TerminationTermination
Either party may terminate an ongoing SOW by providing 30 days' written notice. Upon termination, client shall pay for all services rendered up to the effective date of termination, and Beyond Search will deliver all completed work products.
09 • LiabilityLimitation of Liability
In no event shall Beyond Search's aggregate liability arising out of or related to these Terms or any active Statement of Work exceed the total fees paid by client to Beyond Search in the three (3) months preceding the event giving rise to the claim.
10 • Force MajeureForce Majeure
Neither party shall be liable for any failure or delay in performance resulting from events beyond reasonable control, including acts of God, cloud infrastructure outages, telecommunication failures, government restrictions, or major third-party API deprecations.
11 • LawGoverning Law
These Terms of Service and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the Laws of India.
12 • DisputesDispute Resolution & Contact
Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
